These Terms of Service govern your access to and use of sizechartbase.com and all related SizeChartBase products and services, including public content pages, generators, widgets, APIs, browser extensions, plugins, merchant tools, admin surfaces, and any related software or documentation.
By accessing or using the service, you agree to be bound by these Terms of Service and any policies incorporated by reference. If you do not agree, you must not access or use the service.
2. Eligibility, Accounts, and Authority
You represent that you are legally capable of entering into a binding agreement and, if you use the service on behalf of a company, store, or other entity, that you have authority to bind that entity to these terms.
You are responsible for maintaining the confidentiality of credentials, controlling access to your account, workspace, store connection, or integration environment, and for all activities that occur under your credentials.
3. Customer Content and Merchant Responsibility
You retain responsibility for all content, size data, rules, exports, instructions, and merchant-facing disclosures that you upload, publish, or distribute through the service. You must ensure that such content is accurate, lawful, and does not infringe any third-party rights.
SizeChartBase provides tooling and infrastructure only. Merchants and operators remain responsible for verifying sizing accuracy, product-specific fit information, and compliance with applicable consumer, advertising, ecommerce, and marketplace rules.
4. Permitted Use and Restrictions
You may use the service only for lawful internal business purposes and legitimate customer-facing sizing workflows. You may not misuse the service, exceed authorized access, bypass security controls, interfere with platform operations, or use the service to transmit malware, unlawful content, or deceptive materials.
Unless expressly permitted in writing, you may not sublicense, resell, reverse engineer, mirror, frame, scrape, or create derivative services based on the platform, nor may you use automated means to extract protected content or confidential technical behavior.
5. Intellectual Property and Feedback
SizeChartBase and its licensors retain all right, title, and interest in the service, including software, documentation, product design, trademarks, branding, and all related intellectual property rights. No rights are granted except as expressly stated in these terms.
If you provide feedback, ideas, or product suggestions, you grant SizeChartBase a worldwide, non-exclusive, royalty-free right to use and incorporate that feedback without restriction or obligation.
6. Third-Party Platforms and Integrations
The service may interoperate with third-party platforms, marketplaces, browsers, payment providers, analytics services, app stores, and ecommerce systems. Your use of those third-party services remains subject to the terms and policies of the applicable provider.
SizeChartBase is not responsible for third-party products, outages, policy changes, data handling, or platform decisions outside our control, even where our service integrates with or depends on them.
7. Fees, Suspension, and Termination
Where paid services are offered, you agree to pay applicable fees in accordance with the pricing, billing, and renewal terms presented at the time of purchase or in a separate order form. Failure to pay may result in suspension or termination of access.
We may suspend or terminate access immediately if we reasonably believe you have violated these terms, created legal or security risk, or used the service in a way that could harm SizeChartBase, other users, or third parties.
8. Disclaimer of Warranties
The service is provided on an as-is and as-available basis without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted availability.
SizeChartBase does not warrant that sizing outputs, recommendations, charts, or integrations will be universally accurate, complete, uninterrupted, or error-free for every merchant, product, category, market, or customer use case.
9. Limitation of Liability
To the maximum extent permitted by law, SizeChartBase and its affiliates, officers, employees, contractors, and licensors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business interruption arising from or related to the service.
To the maximum extent permitted by law, any aggregate liability of SizeChartBase arising out of or relating to the service will not exceed the amounts paid by you to SizeChartBase for the specific paid service giving rise to the claim during the twelve months preceding the event giving rise to liability.
10. Changes, Governing Terms, and Contact
We may update these Terms of Service from time to time. The updated version becomes effective when posted unless a later effective date is stated. Continued use of the service after the effective date constitutes acceptance of the revised terms.
